Bialiatski has been imprisoned twice in his life. In 1999, he was sentenced to five years in prison for "extremism" and "anti-state activity" after he helped to organize a meeting to commemorate the victims of the Soviet political repressions. He was released in 2004, but was re-arrested in 2011 and sentenced to six years in prison on charges of "extremism" and "tax evasion". He was released in 2016.
