The Confederate States Army received control of Fort Pickens in late 1861. Slack transferred his command of the Union troops there to his second in command, Lieutenant Adam J. Slemmer, before departing with most of his men. Upon arrival at Fort Monroe in January 1862, Slack was appointed colonel of the 1st Delaware Infantry.
